This License defines the personal and commercial rights granted to the lawful holder of an eligible Cosmic Dream Bog NFT and the intellectual-property rights retained by Cosmic Dream Bog, the Terencio Verde business and applicable third-party rights holders.
Owning a Cosmic Dream Bog NFT means you own the blockchain token according to the applicable smart contract and network rules. Token ownership does not itself transfer ownership of copyright, trademarks, the Cosmic Dream Bog or Terencio Verde brands, project names, world, story, lore, source files, logos, trade dress or other underlying intellectual property. Except for rights expressly granted below, all such rights are reserved.
Subject to this License, the lawful holder of an eligible Cosmic Dream Bog NFT receives a worldwide, royalty-free, non-exclusive license, for the period of lawful ownership, to use, copy, display, perform, adapt and create derivative works from the specific artwork or character content expressly associated with that NFT (the “Licensed Art”) for personal and commercial purposes.
This permits the holder to monetize permitted uses of the Licensed Art without paying an additional artwork-license royalty to Cosmic Dream Bog, unless the holder separately agrees otherwise in writing.
Permitted uses may include merchandise, prints, apparel, media, social content, promotional materials, creative works and other lawful goods or services featuring the Licensed Art. Rights apply only to Licensed Art associated with NFTs the holder lawfully owns. They do not grant rights to unrelated Cosmic Dream Bog characters, other holders' NFTs, project logos, the Terencio Verde brand, or third-party intellectual property not expressly included in the Licensed Art.
A holder may truthfully identify an NFT or artwork as originating from Cosmic Dream Bog, but may not register, claim ownership of, or use TERENCIO VERDE, COSMIC DREAM BOG, project logos or confusingly similar marks as the holder's own trademark, business name, domain, social handle or source identifier without separate written permission. A holder-created product may not falsely imply that it is an official Terencio Verde or Cosmic Dream Bog product, partnership, endorsement or collaboration.
The Licensed Art may not be used in pornography, sexually exploitative material or other obscene uses. These restrictions are contractual limits on the license and will be interpreted consistently with applicable law.
A lawful holder may create permitted derivative works from the Licensed Art while the license is active. The holder owns any copyright that applicable law recognizes in the holder's original contributions, but does not acquire ownership of the preexisting Cosmic Dream Bog intellectual property embedded in the derivative work.
The license is tied to lawful ownership of the applicable NFT. When the holder sells, gifts or otherwise transfers the NFT, the former holder's NFT-linked license to create new uses terminates and the license becomes available to the new lawful holder under these same terms.
A former holder may retain previously manufactured physical items and archival copies created while properly licensed, but may not manufacture new units, launch new campaigns or create new commercial uses after transfer. Existing third-party arrangements entered into in good faith while licensed should be wound down in a commercially reasonable manner.
A person who knowingly possesses an NFT through theft, fraud, unauthorized access or another transaction that does not convey lawful ownership receives no license under this document. Blockchain possession alone does not determine legal title where applicable law provides otherwise.
Some project material may incorporate or reference intellectual property licensed from third parties. This License grants only rights Cosmic Dream Bog is legally authorized to grant. If Licensed Art contains third-party material subject to separate terms, those terms control that material.
If a holder materially exceeds the scope of this License or violates the prohibited-use rules, Cosmic Dream Bog may demand that the prohibited use cease. Where reasonably curable, failure to cure after notice may terminate the license for the offending use. Severe unlawful conduct, knowing infringement, threats, hate-based use or intentional misuse may result in immediate termination to the extent permitted by law. License termination does not by itself transfer or erase the blockchain token.
This license is non-exclusive. Similar themes or elements may appear in other project assets. Cosmic Dream Bog does not guarantee commercial success, market demand, intellectual-property registration, secondary-market liquidity or financial value.
All rights not expressly granted are reserved. Nothing authorizes use of confidential files, unreleased art, source code, other holders' Licensed Art, project trademarks as the holder's source identifier or third-party material beyond rights expressly associated with the holder's NFT.
This License is governed by Texas law and applicable United States federal intellectual-property law, subject to non-waivable legal rights. If a restriction is held unenforceable, it will be narrowed to the maximum lawful scope without invalidating the remaining License.
